Desrochers pleads guilty

LAKE PLEASANT -- A Lake Pleasant man has pleaded guilty to three counts of promoting the sexual performance of a child less than age 17, all in connection with activities June 1, 2012, in the Town of Arietta.

Kevin R. Desrochers, 23, agreed he requested and received three separate digital sexual photographs of an underage girl. The victim is a resident of Arietta.

He appeared in Hamilton County Court Tuesday, July 1, to enter his plea, the result of a negotiated plea bargain reached by his assigned counsel, Lisa Burgess of Indian Lake, and District Attorney Marsha King Purdue.

Fulton County Supreme Court Judge Richard C. Giardino presided. Hamilton County Judge S. Peter Feldstein recused himself, because a parent of one of the victims also works in the county court system.

The plea also satisfies similar charges in Lake Pleasant Justice Court, the initial result of an investigation by Hamilton County Sheriff's Office following an allegation that Desrochers received sexually explicit digital photographs in April 2013 of a 16-year-old Indian Lake girl.

In addition to resolving the four charges, the plea bargain specifies Desrochers will not be held accountable for any "unknown charges," excluding Class A felonies.

The three Class D felonies to which Desrochers has pleaded guilty are punishable by 2-1/3 to 7 years in state prison. Sentencing was set for Sept. 5 at 10:15 a.m.
