INDIAN LAKE -- Developer Richard "Dick" Purdue's plans for a subdivision east of Lake Abanakee here have suffered a setback.
Purdue came before the Indian Lake Planning Board Wednesday, Jan. 8, with a permit application for a seven-lot subdivision of approximately 32 acres between State Route 28 and Chamberlain Road. The land does not border the lake.
Purdue last came before the board with this proposal in July 2012, seeking guidance.
Purdue has a 50-foot wide right-of-way from Rt. 28 into the property that would be the access road. He also holds a 20-foot wide easement from Chamberlain Road, which will be used to bring electricity into the subdivision.
The plan calls for the electricity to be brought in and provided via underground cables.
The area is zoned for one building lot per 3.2 acres. Purdue has said he has no intention of building on the lots, just selling them.
Now that Purdue has filed an application for the development Kathy Bird, who owns property on Chamberlain Road, told the board Purdue's easement encroaches upon her property.
"I did encroach but have had it corrected," Purdue responded.
Bird disagreed, saying Purdue is still encroaching on her land.
With no way for the board to determine the status of the easement, Purdue was told he must have a surveyor determine if it is or is not on Bird's property. Until that is done the board is not willing to rule the application complete.
Following a public hearing brothers Edward and David Bard were granted a conditional use permit to permanently site two large, 40-foot, park model travel trailers on their 54-acre property off Pashley Road.
Eight letters were sent nearby property owners informing them of the hearing. Only one responded, Tim Husson, who endorsed the plan.
The board determined there would be no adverse environmental impact and approved the trailers with two conditions: one must be moved for fire danger separation requirements and a shared septic system needs to be built.
The Indian Lake Planning Board will next meet Wednesday, Feb. 5, starting at 7 p.m. in Town Hall.
