LAKE PLEASANT - William J. Blair of Indian Lake has been sentenced to five years in prison for second-degree rape.
Blair, 28, admitted Aug. 15 to having a three-year sexual relationship with a girl starting when she was 13 years old. He was arrested June 25.
Hamilton County Judge S. Peter Feldstein handed down the sentence Sept. 25. When he is released from prison Blair will be under post-release supervision for 15 years, during which he will be subject to being returned to prison if he violates probation.
A sentence of one year for endangering the welfare of a minor will run concurrently to the five-year sentence. Feldstein also ordered Blair to submit to a HIV test and issued an order of protection.
Blair was ordered to stay away from the victim and her parents, wherever they are; to not communicate with them in any form; and to refrain from any action against them. These conditions will be in force for 23 years, until June 23, 2036.
A sex offender level will not be assigned Blair until after he serves his sentence.
Feldstein also ordered the court records sealed to protect the victim's identity and imposed surcharges of $1,425. The surcharges are a $25 crime victim assistance fee, $50 for a DNA test, a $50 sex offender registration fee, a $300 court surcharge for a felony conviction and a $1,000 supplemental sex offender victim fee.
Blair answered all questions from the judge with "Yeah" or "Yup," with the occasional "Yes."
"Mr. Blair, this is considered a violent felony under the law, due to the seriousness of the crime. When we fail to protect the children in this society we fail to do our job," Feldstein said after passing sentence.
"Your actions in harming this child warrant every bit of the sentence you have gotten... It is my hope that this sentence will serve as deterrent to you and anyone else who might think there is a benefit to outweigh the risks."
Attorney Lisa Burgess of Indian Lake represented Blair. The charges were a result of the victim's age, not because she was forced. In New York state the age for legal consent to engage in sex is 17.
Blair could have received as much as seven years in prison for the rape charge.
He was initially charged with three felonies and one misdemeanor: third-degree rape, a Class E felony; second-degree rape, a Class D felony; second-degree criminal sexual act with a victim under age 15, a Class C felony; and endangering the welfare of a child, a Class A misdemeanor.
He was confined to Hamilton County Jail between his arrest and his sentencing.
