Clearing the air

To the editor:

I would like to clear up some misunderstandings concerning the article entitled, "Indian Lake may consider adopting anti-smoking law."

The banning of smoking on playgrounds is a New York State Public Health Law. The specifics of this can be found in New York State Public Health Law, Article 13-E (Regulation of Smoking in Certain Public Areas) section 1399-0-1.

In this section you will find definitions of outdoor areas, hours of restrictions, age limitations and definitions of what is not included. In this you will also find the effective date beginning Oct. 10, 2013.

In order to get free signage for our playgrounds the Indian Lake Town Board needed to pass a resolution supporting this New York state law. Project Action, a tobacco-free coalition consisting of Hamilton, Fulton and Montgomery counties and St. Mary's Hospital, will supply this signage with a resolution of support of this state law.

In keeping with its tobacco-free outdoors policies, Project Action supplied sample resolutions for the town board to consider. As supervisor I shared these with the board for discussion.

At this time nothing has been discussed nor decided regarding this issue. If you have any questions or concerns after reading Article 13-E please contact me at 648-5885.

Brian E. Wells, supervisor

Town of Indian Lake
